No option for month-to-month tenancy is offered at this time. If for some reason you feel that you are not required to refund my entire deposit, you must provide me with an itemized statement listing all charges. Tenants who have lived in a unit longer than two year, or have a lease of at least two years, must get a day notice from the landlord.
You have been a great tenant and we would like to enter into a new lease of insert lease length. Sending a non-renewal of lease is legal for a landlord to do after a lease expires. Note: Please read your lease carefully.
If you have a month-to-month, or week-to-week lease, the notice requirement could be different. A lease is a contract with a start and end date, as long as that contract is completed no reasoning for nonrenewal is needed. You can also ask about security deposits and move out procedures.
The court will interpret either of these actions as being a default extension for the original lease as one that is now month-to-month. Be sure to bring your copy along so they can point out specific text and sections to help you understand what you need to do.
Always follow the procedures for giving notice as outlined in your lease agreement, because failure to comply may result in extra fees and penalties. Your security deposit and any other deposits such as pet deposits will remain intact and carry over into the new lease term.
